Kent Pegg Sentenced On DUI Charge

Kent Pegg, 53, of Los Alamos was sentenced Feb. 5 in Los Alamos Municipal Court to 90 days in jail with 85 days suspended and placed on a year of supervised probation after pleading guilty to driving under the influence.

 

He also was ordered to pay a $500 fine, perform 48 hours of community service, place an interlock on his vehicle for a year, and pay $250 in court fees.

 

Pegg was arrested the morning of Sept. 7 by Los Alamos Police Sgt. Monica Salazar-Casias after she responded to a report of a person who was possibly intoxicated in his vehicle at 771 Central Ave. The incident report in the case indicates that Salazar-Casias found Pegg sitting behind the wheel and that he appeared to be asleep. When she woke Pegg up, her report states that he told her he was going to work, that he had been there about 20 minutes and that he had driven himself to the location.

 

The incident report indicates that Pegg was having difficulty in answering Salazar-Casias’ questions and she asked him if he had anything to drink since we was parked there and that he told her he had two half-shots of vodka the night before at 10 p.m. It indicates that Pegg had difficulty removing his ID from his wallet, that his eyes were watery and red, and that Salazar-Casias could smell the odor of alcohol coming from his person.

 

Salazar-Casias began administering field sobriety testing but her report indicates the test was terminated for Pegg’s safety after he stumbled and fell to the ground and told her he just wanted to go lie down. She decided it was no longer safe for Pegg to continue with the test and placed him under arrest for driving under the influence.

 

The incident report states that Pegg was transported to the Los Alamos Detention Center and after the required deprivation period, he provided two breath samples, one tested at .30 BrAC and the other at .29 BrAC. Pegg was charged with aggravated driving under the influence and the charge was lowered to driving under the influence under the terms of a plea agreement.
