Greg White Slams Attorneys In Sheriff Duties Case; Asks To File Amicus Brief In District Court

Los Alamos resident and announced candidate for sheriff Greg White has filed an emergency leave for amicus curiae brief request in First Judicial District Court in the ongoing litigation between Los Alamos County Council and Sheriff Marco Lucero.

Amicus briefs are usually filed by a person or group who is not a party to an action with the intent of influencing a court’s decision. The current action is slated for a hearing at 10 a.m. Thursday in the Los Alamos Justice Center, which is open to the public.

Comment Sought On Proposed Forms And Rule For Guardianship And Conservatorship Cases

A 54-page brief has been filed by Los Alamos County attorneys in the ongoing litigation in First Judicial District Court between Sheriff Marco Lucero and the County involving the Sheriff’s duties.

The County’s brief filed by County Attorney Alvin Leaphart and Assistant County Attorneys Kevin Powers and Kathryn Thwaits states that the fundamental problem with Lucero’s position is his failure to accept that the State Constitution “says what it means and means what it says” regarding the charter making authority of the County. First Judicial District Judge Jason Lidyard Visits Post

First Judicial District Judge Jason Lidyard stopped by the Los Alamos Daily Post Monday to visit with public safety reporter Maire O’Neill. The two became acquainted when O’Neill began reporting on District Court cases while Lidyard was a prosecutor for the District Attorney’s office. Municipal Court Releases 16 Outstanding Warrants

Los Alamos Municipal Judge Alan Kirk’s office has released a list of 16 outstanding bench warrants issued for failure to appear in court.

According to Court officials, there are several ways to clear a bench warrant and all of them will require a court date for an appearance before Judge Kirk:

District Attorney Determines Shot Fired By Los Alamos Police Officer In August Incident Was Justified

First Judicial District Attorney Marco Serna has determined that a shot fired by Los Alamos Police Cpl. Robert Larsen during an Aug. 25 incident was justified.

In an April 27 letter to Los Alamos Police Chief Dino Sgambellone, Serna said that based on a complete review of the information submitted to his office, the evidence indicates the discharge of Larsen’s weapon was justified.
