A Santa Fe High School student, Aaron Encinias, will be held in a youth detention center pending trial on a charge of conspiring to engage in terrorist activity.

First Judicial District Judge Mary Marlowe Sommer ordered the detention Tuesday saying Encinias poses a risk to others. Charges against two other students, Santiago Trujillo and Julian Carter were dropped.

AG’s Office Files Brief In Mallory Appeal

Assistant Attorney General Maris Veidemanis has filed a “brief in chief” in an appeal in a local case involving alleged sexual exploitation of children under 18 years by visual media.

Scott Mallory of Los Alamos was arrested in January 2016 after forensic searches of his computer revealed images of young female teenagers, some of which were focused on the clothed breast area and 250 items bookmarked as “child erotica and child pornography”.

Pandey Admits He Should Have Stopped When Victim Pushed Him Away

COURT News:

An incident report filed by Los Alamos Police Det. Matt Lyon indicates that a 31-year-old Los Alamos man charged with aggravated battery, false imprisonment and attempt to commit sexual assault told him he should have stopped, that he knew the victim was not interested after she pushed him away the first time.

Gutierrez Scheduled For Pretrial Hearing Dec. 8

A pretrial hearing has been set for Dec. 8 in Los Alamos Magistrate Court for Jeremy Gutierrez, 32, of Espanola. Gutierrez was arrested Oct. 31 and charged with driving under the influence and possession of a controlled substance.

Los Alamos Police Department Dispatch had received several calls about a reckless driver near the Los Alamos Airport and with the help of a caller who was on the phone with Dispatch, located Gutierrez’s car on Central Avenue. Schmitt Receives Suspended Sentence

COURT News:

 

Robert F. Schmitt, 41, received a 90-day suspended sentence Oct. 23 from Judge Alan Kirk in Los Alamos Municipal Court and was placed on three months of supervised probation on a charge of criminal damage to property of less than $1,000.

Schmitt was arrested Sept. 18 at Smith’s in White Rock for slashing a tire on a truck belonging to another Smith’s employee. Los Alamos Police Department had been called to the store in response to a domestic dispute involving Schmitt. They were called back a little later in response to the report of the slashed tire.

Ruybal Faces Probation Violation Hearing

Casandra Ruybal, 28, of Los Alamos will be back in First Judicial District Court Nov. 20 for a probation violation hearing. If found guilty of the violation, probation officials have asked that she be remanded into custody to serve the remainder of her sentence in the Department of Corrections.
